Notice of Privacy Practices

1. Purpose & Scope
This Notice explains how Trust Point Primary Care uses and discloses your Protected Health Information (PHI). It applies to all PHI in our custody—electronic, paper, or verbal.
2. Protected Health Information (PHI)
PHI refers to any individually identifiable health information, including demographic details, medical history, diagnosis, treatment, billing, and records of communication.
3. Permitted Uses & Disclosures Without Authorization
We may use or disclose PHI without explicit permission for:
- Treatment: To coordinate your care with other providers.
- Payment: To bill insurers, process claims, and collect fees.
- Healthcare Operations: For administrative tasks, quality improvement, provider training, and accreditation purposes.
We may also use or disclose PHI as legally required for:
- Public health reporting (e.g., disease control).
- Reporting abuse or neglect (children, elders, vulnerable adults).
- Law enforcement, court orders, or legal processes.
- Coroners, medical examiners, or funeral directors for death-related purposes.
- Organ and tissue donation coordination.
- Worker’s compensation claims.
All other uses require your written authorization.
4. Your Rights
You have the right to:
- Access and obtain copies of your PHI within 30 days (with a possible 30-day extension).
- Request amendments to correct inaccurate or incomplete PHI.
- Receive an accounting of non-TPO disclosures made in the past six years.
- Request restrictions on uses or disclosures (though we may not agree in all situations).
- Request confidential communications, such as alternate contact methods.
- Receive a paper copy of this Notice even if received electronically.
- File a complaint with our office or with the U.S. Department of Health & Human Services—no retaliation will occur.
5. Your Responsibilities
You agree to:
- Provide accurate information and updates regarding your PHI (e.g., address, phone).
- Inform us of any changes to your contact or health plan information.
6. Safeguards
We maintain administrative, physical, and technical safeguards to protect PHI from unauthorized access, consistent with HIPAA and Florida’s Information Protection Act.
7. Breach Notification
If unsecured PHI is breached, we will notify affected individuals within 30 days and comply with applicable reporting obligations.
8. Business Associates
We may share PHI with third-party vendors (e.g., billing, transcription) under written agreements requiring them to safeguard your information in accordance with HIPAA.
9. Policy Revisions
We reserve the right to amend this Notice. Changes will be effective for all PHI maintained after the revision date and posted or provided upon request.
